Terms of Agreement for online trading between Crystal Mountain Australia (ABN 71 725 252 463) (“Crystal Mountain”) and the user of this website (“You/Your”)
Please read the terms carefully before proceeding with entering the website. You must accept these terms and conditions to access this website any further.
YOUR ACCEPTANCE OF THESE TERMS AND CHANGES TO THE TERMS
By entering this website you agree to these terms and conditions. Crystal Mountain reserves the right to alter this Agreement. Any such changes will be posted on this Website.
YOUR USE OF THE WEBSITE
You agree the website will be used in accordance with these terms and conditions and that you will not use this website for any unlawful purpose. You will not violate or attempt to violate the security of this website. You will not partake in any activity that may cause damage to or interfere with the operation of our computer systems or website.
PLACING AN ORDER AND PAYMENT
By completing an order you are making an offer to purchase the Product at the price set out in the website. Payment must be made at the time of submitting the order. Payment can be made by PayPal only. By completing your order you warrant that you are an authorised user of the PayPal account used to complete payment. All orders placed through this website are subject to confirmation and acceptance by Crystal Mountain. Crystal Mountain may reject your order and refund any payment made by you, at any time prior to dispatch. We will email your order confirmation and the purchase receipt upon order approval.
All transactions are settled in Australian Dollars (AUD). If you are ordering from outside Australia and your bank account or credit card is held in a different currency, your currency will automatically be converted to Australian Dollars when you complete the transaction through PayPal. The final charge to your card is made in Australian Dollars and the ultimate conversion rate is determined by your bank or credit card provider. Conversion rates vary from day to day with the current exchange rate. Many banks also charge a currency conversion fee, contact your bank or credit provider for details. For this reason we are not able to take responsibility for the final amount charged to your PayPal account.
Crystal Mountain reserves the right to vary prices without prior notice.
This website is protected by SSL (Secure Socket Layer) encryption. SSL is a security device which ensures that any data you enter into a secure area of the site is encrypted during transmission over the Internet. SSL utilises data encryption to create a secure environment for you to conduct your online transactions. In order for SSL to be effective you must be using an SSL compliant browser.
Crystal Mountain does not store or keep card numbers from online transactions. The last four numbers and the expiry date of your card number are kept for order verification and identification purposes only. While every endeavour is made to ensure your shopping experience with us is fabulous, in the event a card is used without the holder’s authorisation, the card holder must notify their card provider and/or PayPal in accordance with their reporting rules and procedures.
Crystal Mountain reserves the right to limit the products sold as it sees fit.
This Website is owned and operated by Crystal Mountain Australia. This Agreement supersedes all prior agreements and may be revised.
GIFT VOUCHERS
Gift Vouchers may only be redeemed at our Crystal Mountain retail outlet, they can not be redeemed online. Gift Vouchers are not redeemable for cash. Unfortunately Crystal Mountain does not take responsibility for any lost or stolen Gift Vouchers. Please note a maximum of four Gift Voucher’s can be used per transaction.
RETURNS & EXCHANGES
Crystals, Minerals, Rocks and Fossils are each naturally formed, beautiful and unique. Both appearance and crystalline composition can greatly vary between specimens; no two Crystals are ever the same. Please be aware as natural objects their appearance can vary from the images shown and they may contain tiny fissures, pits and other natural inclusions. Returns and exchanges are not accepted based on varying crystal characteristics.
For all returns and exchanges we require a receipt or proof of purchase.
REFUNDS
Crystal Mountain does not offer refunds based on change of mind or damages and losses incurred during shipping and transport, we will only offer a refund on products we deem faulty.
EXCHANGES
Our exchange policy lasts 14 days and only applies to approved products. To be eligible for an exchange your item must be returned unused and in the same condition that you received it in. It must also be in original packaging. Crystal Mountain will not be held liable for items that are sent back broken or damaged. Crystal Mountain does not reimburse return shipping charges on refunds or exchanges.
You must notify Crystal Mountain and arrange return of the product within 14 days of accepting delivery.
On International returns you must appropriately label the package to ensure the products do not attract possible customs duties and taxes again.
You must return the product in its original condition unused and undamaged.
You are responsible for arranging any insurance on the product.
You are responsible for the cost of the shipment of the product.
You are responsible for ensuring the safe and undamaged return of the product.
Refunds/Exchanges will not gain final approval or be completed until products are received by Crystal Mountain Australia. Please allow 14 days from the day you return the product for your account to be credited. Refunds/Exchanges will only be given to products purchased at the Crystal Mountain Online Store. Refunds will not be given to Crystal Mountain products purchased from our retail outlet.
SALE ITEMS
Please note sale items are final and cannot be returned for a refund or exchange.
RETURN SHIPPING
Crystal Mountain does not cover return shipping charges for refunds or exchanges. We cannot be held responsible for any loss of items during the return process. We advise using registered mail with adequate insurance coverage if you wish to safeguard against any potential damage during transit.
Please ensure you pack your crystals/products carefully with FRAGILE stickers.
Please send an email to info@crystalmountain.com.au and await confirmation before returning your item.
MISSING REFUNDS
If you haven not received you approved refund, first check your bank account again. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and have still not received your refund, please contact us at info@crystalmountain.com.au
Please note that the Trade Practices Act 1974 and similar State and Territory legislation in Australia may confer rights and remedies on you which cannot be excluded, restricted or modified (“Non-excludable Rights”). Notwithstanding any other term in this Agreement, Crystal Mountain does not exclude any Non-excludable rights but does exclude all other conditions and warranties, whether implied by custom, law or statute.
WEBSITE AVAILABILITY
Down-time, either scheduled or unscheduled may occur. Crystal Mountain will endeavor to ensure the amount of down-time is limited. Crystal Mountain will not be held liable for the consequences of any down-time.
INTELLECTUAL PROPERTY
Reproduction of part or all of the contents in any form of this website is prohibited other than for individual use only and may not be copied and shared with a third party. The permission to copy by an individual does not allow for incorporation of material or any part of it in any work or publication, whether in hard copy, electronic or any other form.
Unless otherwise noted, all materials on this website are protected as the copyright, trade dress, trademarks and/or other intellectual properties owned by Crystal Mountain or by other parties that have licensed their material to Crystal Mountain. Trademarks on this site represent some of the trade marks currently owned or controlled in Australia. The display of these marks and of notices associated with these marks is not intended to be a comprehensive compilation of all worldwide proprietary ownership rights held by Crystal Mountain.

TERMINATION
Crystal Mountain reserves the right to terminate this agreement at any time. Crystal Mountain shall not be liable to you for any cost, expense or damages whatsoever for terminating this agreement.
If the product has not been delivered to you prior to any termination of this agreement by Crystal Mountain, Crystal Mountain will refund to you any payment you have made prior to termination.
DEFINITIONS
“Agreement” means the terms and conditions that apply to the use of this Website which may be amended.
“Crystal Mountain” means Crystal Mountain Australia and CMGL- Crystal Mountain Gemmological Laboratory (ABN 71 725 252 463).
“Product/s” means the product that is specified on the Order as the product you wish to purchase pursuant to the Agreement.
“Order” means the online purchase to be completed by you in relation to your purchase of the product.
“Website” means internet website with the URL www.crystalmountaincrystals.com and associated websites.
“You/your” means the user of the website.
